Privacy Policy

ABYA® respects the confidentiality of its online visitors and users of its products and services, and complies with the protection of confidentiality and use of personal data framework, according to the legislation in force in each territory. ABYA recognizes the importance of protecting the information collected from users and has adopted this confidentiality policy to inform users about how ABYA collects, stores and uses the information that derives from their use of ABYA’s products, services and online sites.

This text could be modified in the future to reflect the changes and additions made to the confidentiality policy.

Information Collection

By using ABYA's online sites, products and services, users consent to ABYA collecting their personal data provided when creating an ABYA account, when buying or selling subscriptions, or during any exchange with ABYA related to the use of your ABYA account. ABYA will not share its clients' personal data with third parties, except as described here. ABYA also processes anonymous data, collective or not, in order to analyze and compile statistics related to habits, usage patterns and demographic data of users as a group or individually. This anonymous data is not personal data according to the legislation, as it does not allow the identification of the users to whom it refers. ABYA may share anonymous data, aggregated or not, with third parties.

Use of personal data of users

The personal data of users will be used internally by ABYA and its partners to offer, develop and improve products, content and services, to which users have subscribed to, and to respond to user requests. In addition, ABYA may allow third parties that perform services under contract with ABYA to access and use personal data as processors, but only to the extent necessary to provide such services.

ABYA may use personal data provided by users to send them information about ABYA and its products, such as news about product updates, contests, events and other promotional materials, but only if users consent to receiving such communications. In addition, when you use ad-supported services such as an ad-supported plan of GeForce NOW, we collect and share information to personalize advertisements for you. ABYA will not share personal data with third parties for their use for marketing purposes.

When creating an ABYA account, ABYA asks the user for their email address and username and, optionally; the user's first and last name. Depending on their configuration, users consent to some of this information being searchable and available to other ABYA users. ABYA has no obligation to maintain the confidentiality of personally identifiable information that a user has made available to other users through ABYA or any of its products, such as in multiplayer chat and other public functions.

ABYA may make personal data of users public in response to court orders or laws that require such information to be disclosed. In the event of reorganization, sale or merger, ABYA may transfer personally identifiable information to the concerned third party.

"Cookies" and other information on the user's computer

ABYA’s products, services and sites may use "cookies" and other technologies. Cookies are small files of electronic information that can be transferred to a user's hard drive to personalize a person's use of an online product or site, keep records of a user's access to an online site, or a product or store the information that the user needs on a regular basis. However, users can disable cookies by changing their browser settings.

That information includes a unique authorization key or CD key that the user automatically enters or downloads during the product registration process. This authorization key is used to identify valid users and allow them access to ABYA products and services, as well as third-party games. This key is necessary for ABYA to be able to provide the products and services to which users have subscribed.

In relation to the use of ABYA and its products by the user, information regarding the billing of said products, the ABYA account, the user's hardware, their Internet connection and the ABYA software installed on the user’s device is uploaded to the server. ABYA software automatically generates and sends ABYA error reports when a crash or other failure occurs in ABYA software or services. This automatically generated error report may include information about the user's device’s hardware or other software. ABYA does not associate or store the automatically generated error report with the personally identifiable information of users. Any bug reports manually submitted by users (for example, via the ABYA bug reporting form) are associated and stored with personally identifiable information voluntarily submitted by the user via the bug reporting.

Chat, forums, etc.

ABYA products or services may provide users with chat, forums, bulletin board systems (BBS) or instant messaging tools. Any information posted via chat, forums or bulletin board systems (BBS) should be considered public information; users who send messages to each other may not know each other personally. ABYA has no obligation to maintain the confidentiality of personally identifiable information that a user makes available to other users or to the public using those features. Users should exercise caution when deciding whether to disclose personal information in public forums. In addition, users should be aware that the information for the game that is provided during a multiplayer game (for example, the name of the player and the current statistics of the player) is public information that may be seen by other users.

Options to not receive communications

ABYA provides its users with promotional communications from ABYA through email. Users can decide to not receive those communications. To stop receiving promotional communications from ABYA by email, the user must send an email to support@abya.com with the subject "Opt out".

Storage and security of personally identifiable information

ABYA has taken reasonable measures in accordance with current legislation to protect the information that users provide, including, but not limited to, configuring processes, equipment and software to prevent unauthorized access to that information or its disclosure.

Payment information

The processing of payments related to Content and services and/or physical goods purchased from ABYA is performed either directly by ABYA or an external payment processor. In any case, both the delivery of Contents and services and that of physical goods will be carried out by ABYA.

Right of access, modification, update or deletion of personal data.
